| Province of Marinduque Lawsuit on Marcopper Disaster |
| The Province's appellate argument took place on Tuesday morning at the Federal Courthouse in San Francisco California. We believe that the argument went extremely well.The advocacy on behalf of the Province could not have been better, and the Judges seemed to be very in tune with thekey issues. We will likely not receive the court's ruling for some time, perhaps weeks or even a couple of months. Although there are never guarantees in litigation, we are cautiously optimistic that the court will rule in the Provinces' favor based on the strength of the Province's briefs and its oral argument yesterday. |

| If the panel rules in favor of the Province, it can do one or three things: 1). the case could be returned to state court for trial; 2) the case could be returned to federal court for trial; or 3) the case could be conditionally dismissed in favor of the Philippines, and Barrick/Placer. Dome would be forced to choose between litigating in Nevada and litigating in Marinduque. Any of these three options would be a victory for the Province.
